Visas

A visa is essentially an entry ticket into the United States. They typically fall into one of the two categories:

Non-Immigrant Visas: This type of visa is for those who wish to enter the United States and stay for a particular purpose or period of time.  Student, tourist, and certain specialized work programs are examples of non-immigrant visas.

Immigrant Visas: Immigrant visas are for individuals who want to legally reside in the United States on a permanent basis.  Immigrant visas are generally available due to family relationship or are employment-based.

Legal Permanent Residence

Legal Permanent Residence, or Green Card Status, allows a non-citizen to permanently reside and work in the United States. There are multiple reasons for Green Card approval such as:

  • Employment Categories

  • Family Petitions

  • Special Immigrant Status

  • Refugee or Asylee Status

  • Victims of Abuse

  • Other special means of eligibility

If someone is not currently in the United States, a Green Card may also be approved through consular processing at a U.S. embassy or consulate. The road to Legal Permanent Residence can be both tricky and complicated. The attorneys at Bair Wilson Sharma, LLC know how to expertly assist you through this process.

Naturalization

Naturalization is the process by which an individual becomes a citizen of the United States. As part of the naturalization process, you must pass a U.S. civics test and show proficiency in reading and writing in the English language.

Removal Defense

Any non-U.S. citizen can face removal proceedings (also known as “deportation” proceedings) depending on their past immigration history, criminal history or lack of current immigration status. Many people facing removal proceedings have substantial connections to the United States and have spent years here establishing their lives. The prospect of having your life stripped away from you is something no one should ever face alone. For the year 2020, U.S. Immigration and Customs Enforcement reported the removal (“deportation”) of 185,844 individuals from the United States. This number increases annually.  If you or your loved one is facing removal proceedings in immigration court, contact our team as soon as possible.
